By accessing or using SMS Phone API, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

SMS Phone API provides an SMS gateway service that allows users to send and receive SMS messages through their Android devices via our API and mobile application.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized access
  • You must be at least 18 years old to use this service

4. Acceptable Use

You agree NOT to use SMS Phone API to:

  • Send spam, unsolicited messages, or bulk marketing without consent
  • Transmit malicious content, viruses, or harmful code
  • Engage in fraud, phishing, or deceptive practices
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, threaten, or harm others
  • Send messages to numbers that have opted out

5. API Usage

  • API keys are for your use only and must not be shared
  • You must comply with rate limits for your plan
  • Excessive API abuse may result in account suspension
  • You are responsible for all activity under your API key

6. Fees and Payment

  • Some features require a paid subscription
  • Fees are billed in advance on a monthly basis
  • Refunds are handled on a case-by-case basis
  • We may change pricing with 30 days notice

7. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may suspend service for maintenance with reasonable notice
  • SMS delivery depends on carrier networks beyond our control

8. Intellectual Property

All content, features, and functionality of SMS Phone API are owned by us and protected by intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED „AS IS“ WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

11. Termination

  • You may cancel your account at any time
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, your data will be deleted within 30 days

12. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by the laws of Serbia, without regard to its conflict of law provisions.
